By accessing or using Huxly (“Service”), operated by SwyftForm LLC (“Company”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Huxly is an AI-powered mobile application development platform that enables users to create, design, and deploy mobile applications using React Native (Expo) and Flutter frameworks. The Service includes AI-assisted code generation, design tools, preview capabilities, and deployment features.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains accurate and up-to-date

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Create malicious software, malware, or harmful applications
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Generate content that is illegal, harmful, or offensive

5. Intellectual Property

You retain ownership of all code and content you create using the Service. However, Huxly and its licensors retain all rights to the Service, including but not limited to the platform, AI models, templates, and documentation. The code generated by our AI is provided for your use, but you are responsible for ensuring compliance with any third-party licenses.

6. Payment Terms

Certain features of the Service require payment. By subscribing to a paid plan, you agree to pay all fees associated with your selected plan. Fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days notice to existing subscribers.

7. API Usage and Third-Party Services

The Service integrates with third-party services including AI providers (Anthropic, Google, OpenAI), cloud platforms (Supabase, Cloudflare, Firebase), and version control systems (GitHub). Your use of these integrations is subject to their respective terms of service. We are not responsible for any issues arising from third-party services.

8. Limitation of Liability

To the maximum extent permitted by law, Huxly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately. You may export your data before termination.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
